WellGet® Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and WellGet® ("WellGet," "we," "us," or "our") and govern your access to and use of our website, mobile experiences, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

1 Eligibility

📅 Age Requirements

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Platform. If you are 16—17 years old, you may use the Platform only with the consent and supervision of a parent or legal guardian who accepts these Terms on your behalf.

You represent and warrant that all information you provide is accurate and complete, including (for Member users) a correct UPI ID for rewards.

2 Account Registration & Security

Key Security Requirements

  • Single account: One account per individual. Creating or maintaining multiple accounts is prohibited.
  • Credentials: Keep your username and password confidential. You are responsible for all activity under your account.
  • Updates: Keep your profile (e.g., UPI ID, PAN, contact details) accurate and up to date.
  • Notice of misuse: Notify us immediately at support@wellget.in of any unauthorized use.
  • Non-transferable: You may not sell, transfer, or assign your account or any rights under it.

If your account is deleted for policy violations, fraud, or misuse, any balance may be forfeited to the extent permitted by law.

4 Account Types

5 Rewards, Credits & Wallet

💳 Important: Credits are NOT Legal Tender

Credits are loyalty/reward points within the Platform. They are not legal tender, deposits, or interest-bearing instruments and have value only as described here.

  • Wallet: Your wallet shows your current credit and fund balances. We may correct errors, reverse or hold credits/balances in cases of suspected abuse, chargebacks, or policy violations.
  • Fraud checks: We may require KYC and other verification before enabling transfers or withdrawals.

🆔 PAN Card Requirement

A valid PAN is mandatory to process withdrawals. One PAN may be linked to only one user account. Duplicate PAN use across accounts can result in permanent blocks and forfeiture of balances.

  • Profile accuracy: If a payout fails due to incorrect user details, we are not responsible for re-issuing the payment until correct details are provided.
  • Taxes: We may deduct TDS and any other applicable taxes or levies as required by law.

7 Credit Point Transfers & Settlement

Credit points may be allocated or transferred as follows:

  • Transfer to Business accounts: You may transfer credits to your own or a third-party Business account. Transfers made to a wrong account due to incorrect details are your responsibility.
  • Platform-facilitated sale: We may list your credits for sale on the Platform. There is no guaranteed timeline. Funds are credited after a successful buyer purchase.
  • Direct peer-to-peer settlement: You may contact sellers/buyers directly. Such transactions are strictly between users; WellGet does not mediate, guarantee, or assume liability for any disputes.

8 Prohibited Conduct

🚫 Strictly Forbidden Activities

  • Creating multiple accounts, or using bots, scripts, emulators, VPNs/proxies to manipulate views, Q&A, or rewards.
  • Attempting to reverse-engineer, interfere with, or disrupt the Platform, security, or reward systems.
  • Posting or promoting illegal, misleading, harmful, or infringing content.
  • Any activity that violates applicable law or these Terms.

9 Anti-Fraud & Enforcement

⚖️ Enforcement Actions

We may freeze or reverse credits, suspend features, or terminate accounts (with or without prior notice) if we suspect policy violations or fraud. We may request identity/address proof or other verification. Serious or repeated violations may lead to permanent blocks and forfeiture of balances as permitted by law.

10 Advertising & Content Rules (Business Users)

📢 ASCI Compliance Required

Ads must comply with all applicable laws and the Advertising Standards Council of India (ASCI) guidelines.

  • No illegal products/services, unsafe claims, discriminatory content, or violation of third-party rights.
  • All claims (e.g., pricing, discounts, availability) must be truthful, current, and supported by evidence.
  • We may reject, remove, or restrict ads at our discretion.

11 Service Changes

We may modify, suspend, or discontinue any feature, content, or the Platform (in whole or part) at any time. We may also update these Terms. Changes are effective when posted. Your continued use means you accept the changes.

12 Intellectual Property

The Platform, including text, graphics, logos, videos, software, and other materials, is owned by WellGet or its licensors and is protected by law. You must not use our trademarks (including "WellGet" and associated logos) without prior written consent.

13 Third-Party Stores, Links & Offers

⚠️ No Responsibility for Third Parties

We are not responsible for the quality, policies, stock, pricing, support, or content of third-party stores or advertisers. Deal directly with the relevant third party for customer service. We do not endorse or guarantee third-party offers.

14 Disclaimers

To the maximum extent permitted by law, the Platform is provided on an "as-is" and "as-available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

15 Limitation of Liability

To the extent permitted by law, WellGet will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Platform.

16 Indemnity

You agree to indemnify and hold harmless WellGet and its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the Platform, your content, or your breach of these Terms.

17 Governing Law & Dispute Resolution

⚖️ Jurisdiction

These Terms are governed by the laws of India. Subject to arbitration below, courts in Ahmedabad, Gujarat shall have exclusive jurisdiction.

Any dispute may be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by WellGet. The seat and venue of arbitration shall be Ahmedabad, Gujarat. Proceedings shall be in English.

18 Electronic Communications

You consent to receive communications from us electronically (email, SMS, in-app notices). You agree that all notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.

19 Miscellaneous

Additional Terms

  • No waiver: Our failure to enforce any right does not waive it.
  • Severability: If any provision is unenforceable, the remainder remains in effect.
  • Assignment: You may not assign these Terms without our consent; we may assign them.
  • Entire agreement: These Terms and the documents referenced herein are the entire agreement between you and us regarding the Platform.
